Hi Karen,
I reviewed the original by-laws and if a unit (voter), does not physically join the meeting or does not
submit a proxy, then the unit is not voted. I take this to mean the unit does not count for that vote
and would not be part of the quorum.
Roberts rules says, majority or 2/3 is of those present physically or by proxy,
So one would think if you are not present physically or by proxy, you don't count in that vote.
I think this needs to be looked at, otherwise we will never get a 2/3 vote and nothing will ever
get done. This will cost us money and aggravation.
I suggest we look at the current by-laws and if the above looks to apply, get a lawyer to agree,
then make it clear if you don't vote physically or by proxy, you have no say it what happens to
your building. That may get at least some more proxies.
